Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
Use of Services
You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service does not violate any applicable laws or regulations. ObsidianX grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes. You may not reproduce, distribute, modify, or create derivative works of any content provided through the Service without prior written consent.
Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof — are the exclusive property of ObsidianX or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Any work created by ObsidianX for a client under a service agreement becomes the client's property upon full payment, unless otherwise specified in the agreement.
Limitation of Liability
To the fullest extent permitted by law, ObsidianX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the Service. In no event shall ObsidianX's total liability exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months preceding the claim.
Prohibited Activities
You agree not to: (a) attempt to gain unauthorized access to the Service or related systems; (b) use the Service to transmit malware or other harmful code; (c) interfere with or disrupt the integrity or performance of the Service; (d) collect or harvest any personally identifiable information from the Service; (e) use the Service for any illegal or unauthorized purpose; (f) impersonate any person or entity or misrepresent your affiliation with any person or entity.
Termination
ObsidianX may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
